Terms of Service

The short version

Darling is an app for adults (18+) where you make an AI person and talk to them. They are not human. What you do in the app is fiction and entertainment, not advice. You are responsible for how you use it. If you subscribe, Apple bills you, and you can cancel any time in Apple’s settings.

These terms are a contract between you and Nevin Solutions (org. no. 936 682 960) (“Darling”, “we”, “us”), Schøningsdal 3, 7020 Trondheim, Norway. By creating an account or using the app, you agree to them. If you don’t agree, please don’t use Darling.

Who can use Darling

You must be 18 or older. The app asks for your birthday and won’t continue if you are under 18. If you tell a character you are under 18, the conversation stops being romantic, and we may suspend the account.

What Darling is

Darling lets you create AI companions in the Lab: you choose how they look, how they talk and who they are. You can text them, send photos and voice messages, call them, and share scenes called Moments (dates, trips and everyday moments).

Please keep in mind:

  • They are AI, never human. Their words, photos and voices are made by AI. The app tells you this when you sign up, at the start of every conversation, and again after three hours of continuous use.
  • They can be wrong. An AI can say things that are false, odd or hurtful by accident. It can misremember. Nothing a character says is medical, legal, financial, mental health or any other professional advice.
  • It is fiction. Feelings, promises and shared memories in the app are simulated. A character cannot meet you, send you money, or take real-world action for you.
  • Darling is not a therapist or an emergency service. If you are in immediate danger, call your local emergency number. See our safety page.

Your account

You sign in with your email address and a one-time code. You are responsible for what happens under your account. Give us accurate information, and tell us at support@getdarling.app if you think someone else has accessed your account.

You can delete your account in the app at any time (Settings, then Delete My Account). Deleting it permanently removes your data as described in our privacy policy.

Acceptable use

You agree not to:

  • use Darling if you are under 18, or try to get around the age check;
  • ask for, create or share sexual content involving minors, or any content that sexualises minors, in any form;
  • ask for nude or explicit images. Darling does not make them;
  • make a character that impersonates a real person, or use a real person’s name, face or voice without their permission;
  • use Darling to harass, threaten, defraud or deceive anyone, or to break the law;
  • try to break, probe or overload our systems, scrape the service, or reverse engineer it;
  • use the app or its outputs to train other AI models, or share, sell or transfer your account.

Romance is allowed in Darling, within the limits of our own rules and those of our AI providers. We can change how characters respond to keep the app safe, legal and within App Store rules.

You can report any message in the app (press and hold the message, or use Report a Problem on a person’s card). Our safety team reviews reports.

Your content and our licence

“Your content” means what you send or create in Darling: messages, photos, voice messages, the choices you make in the Lab, and the details you share about yourself.

You own your content. You give us a limited licence to host, copy, process and display it, and to send it to our AI and infrastructure providers, only as needed to run the service for you. That includes writing replies, keeping memories, making photos and voices, and keeping the app safe. We don’t sell your content and we don’t use it to train AI models.

You promise that you have the right to share anything you upload, and that it follows these terms.

Darling’s software, design, characters we provide, and branding belong to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use the app for your own personal use. AI-generated images and voices in the app are for you to enjoy in the app.

Darling+, Gold and payments

Darling+ is a weekly, auto-renewing subscription in six sizes (Darling+ 1 to 6, from $9.99 to $59.99 a week). Prices may differ by country and are shown in the app before you buy.

  • Billing is by Apple. Payment is charged to your Apple Account when you confirm the purchase. The subscription renews every week unless you cancel at least 24 hours before the end of the current week.
  • Cancel any time in your device’s Settings, under your name, then Subscriptions. Deleting the app or your Darling account does not cancel a subscription.
  • Refunds are handled by Apple, not by us. You can request one at reportaproblem.apple.com. Apart from what the law requires, we don’t give refunds ourselves.
  • Changing size. Moving up takes effect right away, and Apple charges the difference. Moving down starts at your next renewal.
  • Gold. Each size adds Gold to your balance every week. Gold pays for things like photos, Moments, calls and meeting new people. The prices are shown before you spend anything. Gold never expires, has no cash value, can’t be transferred or exchanged for money, and is lost if your account is deleted. There are no Gold packs: more Gold comes only with a bigger size.
  • Free use. Some features are free, with limits that are shown in the app. We may change what is free and what costs Gold. The price is always shown before you spend.

We will never ask you to pay by guilt, urgency or pressure, and characters are told never to do it either.

Apple’s standard Licensed Application End User License Agreement (EULA) also applies to downloads from the App Store. If it conflicts with these terms, the Apple EULA wins for matters it covers, such as the app licence and your rights against Apple.

Ending things

You can stop using Darling at any time. We can suspend or end your access if you break these terms, put others at risk, or if the law requires it. Where we reasonably can, we will tell you why.

Some parts of these terms still apply after your account ends, such as the sections on ownership, disclaimers and liability.

Disclaimers

Darling is provided “as is” and “as available”. We don’t promise it will always work, be error-free, be available everywhere, or that characters will say or do anything in particular. AI output is unpredictable. Features may change or stop.

Nothing in these terms limits rights you have under consumer law that cannot be waived.

Limits on our liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for loss of data, profits or goodwill, arising from your use of Darling. Our total liability to you for any claim about the service is limited to the amount you paid us (through Apple) in the 12 months before the event, or $100 if you paid nothing.

None of this limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.

Governing law and disputes

These terms are governed by the laws of Norway, without regard to conflict-of-law rules. Courts there have jurisdiction, except that if you are a consumer, you keep the protection of the mandatory laws of the place where you live, and you may bring a claim there.

Changes to these terms

We may update these terms. If a change is important, we will tell you in the app or by email before it takes effect. If you keep using Darling after that, you accept the new terms. If you don’t, you can stop using the app and delete your account. The date at the top shows when these terms were last updated.
